Welcome to the Law Offices of A. Gina Hogtanian. Ms. Hogtanian is a general civil and appellate litigator, who has been practicing law for 19 years.
Since 1994, Ms. Hogtanian’s practice has concentrated in the representation of individuals and businesses in civil disputes litigated in state and federal trial courts, as well as appellate courts. Her cases have included business disputes, personal injury/wrongful death actions, employment discrimination matters, contract disputes, industrial accidents, construction defect and property damage claims.
Her approach to the practice of law entails utmost dedication to her clients, thorough preparation for all matters (large or small), exploring the least costly dispute resolution methods early on, and zealous, but professional advocacy throughout.
More than any other area of law, appellate practice depends heavily upon written presentation of legal arguments. Ms. Hogtanian has consistently received honors and praise for her written and oral advocacy skills from her peers, law school professors, colleagues, and judges alike. While in law school, Ms. Hogtanian received the American Jurisprudence Award for Advanced Legal Research and Writing. In practice, Ms. Hogtanian has been able to win many of her cases “on the papers,” without the need for a prolonged and costly trial. In 2004, Ms. Hogtanian was voted by her colleagues in the legal profession as a “Rising Star in Civil Litigation” through Los Angeles Magazine’s publication of “Southern California Super Lawyers.”
Ms. Hogtanian’s past successes have included appellate matters, as well as many winning dispositive motions (or oppositions), such as demurrers, summary judgment motions, motions to dismiss, and post-trial motions, including:
♦ Winning Petition for Review to the California Supreme Court in a case involving third party crime on the premises, resulting in reversal of the decision of the Court of Appeal. Sharon P. v. Arman Ltd. (1999) 21 Cal. 4th 1181 (disapproved on other grounds in Reid v. Google, Inc. (2010) 50 Cal.4th 512, 523. Appeals to the California Supreme Court are completely discretionary, and statistics then placed the odds of review being granted by the Court below 5%.
♦ Winning Opposition to Petition for Writ of Certiorari to the U.S. Supreme Court based on the Equal Protection and Due Process Clauses of the U.S. Constitution in the same case. Cert. denied at 530 U.S. 1243 (2000).
♦ Affirmance of a defense verdict on appeal in an admitted liability traffic accident matter.
♦ Obtaining dismissals of alleged RICO/Fraud action against three defendants at the early pleadings stage, with no depositions being taken.
♦ Defense judgment on behalf of a restaurant business and its Vice President of Operations in an alleged employment discrimination/wrongful termination matter.
♦ Defeating summary judgment in a wrongful death case involving a dangerous condition of public property claim against a public entity.
♦ Winning summary judgment in a negligent entrustment claim against a car dealership based on alleged lack of a driver’s license by the lessee.
♦ Defeating the injury claim of a law enforcement officer based on the “Fireman’s Rule” through summary judgment.
♦ Limiting liability of a business to the statutory liability of owner of car by showing the employee was not driving the car during “the course and scope of his employment” under California case law precedents.
♦ Defeating the “on-the-job” injury claims of subcontractor employees based on the Privette/Toland doctrine of non-liability of a hirer of a contractor for injury claims of contractor employees covered by workers’ compensation insurance.
